  • "Agreement" means these Terms and Conditions together with any engagement letter or service confirmation issued by us.
  • "We / Us / Our" refers to Suk Niti, operating from 156 Phaya Thai Road, Ratchathewi, Bangkok 10400, Thailand.
  • "User / You / Your" means any person who accesses this website or engages our services.
  • "Service" means the pension legal advisory services offered by Suk Niti, including Initial Pension Consultation, Records & Documentation Support, and Tribunal Preparation & Representation.
  • "Content" means any text, documents, information, or materials provided by either party in connection with the Agreement.
  • "Website" means the site located at sukjaila.pro.

2. Acceptance of Terms

By using this website or instructing us to act on your behalf, you confirm that you have read, understood, and accept these Terms. If you do not agree, you should not use this website or engage our services.

Our services are available to individuals aged 18 years and over who have the legal capacity to enter into a binding agreement. By proceeding, you confirm that you meet these requirements.

Where you act on behalf of a third party (for example, an elderly relative), you confirm that you have the authority to do so and that you accept these Terms on their behalf as well as your own.

3. Service Description

Suk Niti provides pension legal advisory services to individuals in Thailand. Our services currently include the following.

Initial Pension Consultation

A first meeting to review your situation, explain options, and set out possible paths. Includes a written summary.

Records & Documentation Support

Assistance assembling, reviewing, and organising records needed for your pension matter. Includes a document file and guidance notes.

Tribunal Preparation & Representation

Full preparation and representation for formal hearings. Includes submission drafting, hearing attendance, and a clear costs outline.

Services are offered to clients located in Thailand. We reserve the right to decline instructions where it would be inappropriate for us to act, or where we are unable to assist for regulatory or practical reasons.

Availability of specific services may change. We will inform you if a requested service is temporarily unavailable and discuss suitable alternatives.

4. User Responsibilities

4.1 Accuracy of Information

You agree to provide us with accurate, complete, and up-to-date information when requesting services or making contact. We rely on the information you provide; inaccurate details may affect the advice or assistance we are able to offer.

4.2 Acceptable Use of Website

When using this website, you agree not to:

  • Attempt to gain unauthorised access to any part of the website or its systems.
  • Use the website for any purpose that is unlawful, harmful, or likely to cause offence.
  • Transmit malicious code, spam, or any content that interferes with the normal operation of the website.
  • Reproduce or distribute website content without our written consent.
  • Misrepresent your identity or affiliation.

4.3 Cooperation

We grant you a limited, non-exclusive, non-transferable licence to access and use this website for the purposes of obtaining information about our services and contacting us. This licence does not permit commercial reproduction, redistribution, or adaptation of our content.

Documents prepared for you specifically in the course of a service engagement are provided for your personal use in connection with your pension matter. They may not be shared commercially or used as the basis of services provided to others.

6. Payment Terms

6.1 Fees

Fees for each service are set out on our website and confirmed in our engagement letter. All fees are stated in Thai Baht (฿) inclusive of applicable taxes unless stated otherwise.

6.2 Payment

Payment arrangements will be confirmed at the outset of each engagement. For consultation and documentation services, payment is typically required before commencement. For representation matters, a staged payment schedule will be set out in the engagement letter.

6.3 Refunds

If you cancel an engagement before work has commenced, any fee paid will be returned in full. Where work has begun, we will apply a reasonable reduction reflecting the time and effort already expended. Refunds will be considered individually, and we will deal with each request fairly and promptly.

7. Service-Specific Terms

7.1 Scope of Work

The scope of each service engagement is confirmed in our engagement letter. Where your matter develops in a way that requires additional work beyond the original scope, we will discuss this with you and agree any changes before proceeding.

7.2 Confidentiality

We treat all information shared with us in the course of a service engagement as confidential. We will not disclose your details or the particulars of your matter to third parties except where required by law, or where you have given your consent.

7.3 Timelines

We will provide you with an indication of expected timelines at the start of each engagement. These timelines are estimates based on typical matters and may be affected by factors outside our control, including the responsiveness of third parties, tribunal scheduling, and the complexity of your records.

8. Disclaimers

The information on this website is provided for general informational purposes only. It does not constitute legal advice and should not be relied upon as such. Your individual circumstances will always affect the options available to you.

We do not make any representation about the outcome of any pension matter. Each case is different, and the assistance we provide is intended to support your position as fully as possible — not to assure any specific result.

While we take reasonable steps to keep the content on this website accurate and up to date, we cannot warrant that all information is current or free from error. We recommend you contact us directly for advice relevant to your situation.

9. Limitation of Liability

To the extent permitted by Thai law, our total liability to you in connection with any service engagement shall not exceed the fees paid by you for that specific engagement.

We shall not be liable for any indirect, consequential, or incidental losses arising from your use of this website or from the services we provide, including loss of income, loss of opportunity, or loss of data.

Nothing in these Terms limits our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable Thai law.

10. Indemnification

You agree to indemnify and hold Suk Niti harmless from any claims, losses, costs, or liabilities (including reasonable legal fees) arising from your misuse of this website, your breach of these Terms, or any inaccurate information you have provided to us that causes harm to a third party or to us.

This indemnity applies only to losses arising directly from your actions or omissions and does not apply to matters caused by our own negligence or default.

11. Termination

11.1 By You

You may end an engagement at any time by notifying us in writing. We will complete any work already in progress and invoice for reasonable costs incurred to that point in accordance with the payment terms in section 6.

11.2 By Us

We reserve the right to decline or discontinue an engagement if a conflict of interest arises, if continuing would place us in breach of our professional obligations, or if you have failed to comply with a material term of the Agreement.

11.3 Survival

Clauses relating to intellectual property, liability, indemnification, confidentiality, and dispute resolution will survive the termination of any engagement or of these Terms.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand, including applicable provisions of the Civil and Commercial Code and the Consumer Protection Act B.E. 2522.

12.2 Jurisdiction

Any dispute arising under or in connection with these Terms shall be subject to the jurisdiction of the courts of Bangkok, Thailand.

12.3 Informal Resolution

Before initiating any formal proceedings, both parties agree to make a genuine effort to resolve the matter informally by direct communication. If you have a concern about our services or conduct, please contact us at [email protected] and allow ten working days for us to respond.

13. General Provisions

Entire Agreement. These Terms, together with any engagement letter or service confirmation, constitute the entire agreement between us with respect to the subject matter and supersede any prior communications or understandings.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver. Our failure to enforce any provision of these Terms on any occasion shall not be construed as a continuing waiver of that provision.

Assignment. You may not assign or transfer your rights under these Terms to another party without our written consent. We may assign our obligations to a successor entity in connection with a business reorganisation.

Notices. Notices under these Terms should be sent in writing to our address or by email to [email protected]. We will acknowledge formal notices within five working days.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, applicable law, or our operational practices. The current version will always be available on this page, with the date of last revision noted at the top.

Where changes are material, we will endeavour to draw them to your attention. Continued use of this website or our services after any change takes effect constitutes acceptance of the revised Terms.
